Terms and conditions

1. Sherpas Ride Travel s.r.o. 

Sherpas Ride Travel s.r.o. (hereinafter referred to as „Sherpas ride“) is a registered travel operator with insurance against bankruptcy and organizes sport and travel trips (hereinafter referred to as „Trips“) for its clients (hereinafter referred to as „Guests“).

2. General Terms & Conditions

These General Terms & Conditions (hereinafter referred to as „Terms and Conditions“) govern the rights and obligations between Sherpas Ride and its Guests with respect to participation at any Trips organized by Sherpas Ride or any other agreement between Sherpas Ride and the Guest(s) unless the parties of this agreement agree differently. In case the parties to such agreement agree differently concerning a part of the terms and/or conditions governed by these Terms & Conditions, the rest of the Terms & Conditions (that have not been agreed differently) remains valid.

3. Payments and Bookings

Any Guest willing to participate in any Trip has to make an obligatory booking, confirmed by agreeing to the Terms & Conditions and covering an advance payment for the respective Trip.

The advance payment of 30% of the total cost of any Trip is due within 5 days after a booking is made. The balance of the total cost of the Trip must be paid no later than 90 days before departure. In case the booking is made within the last 90 days prior to the Trip, the full cost must be paid within 5 days after booking. If the balance is not paid in time Sherpas Ride reserves the right to cancel the booking and forfeit the advance payment.

4. Costs

The costs of all Trips facilitated by Sherpas Ride, together with Trips’ program are described at Sherpas Ride websites. The costs do not cover additional fees and parts of the program that are not described at Sherpas Ride websites, namely: individual insurance, flight tickets, compensations for not participating in the whole program of a Trip and compensations for lifts or cable cars closure in the venue where the respective Trip takes place. The cost of the Trip is to be paid via a bank transfer to Sherpas Ride bank account. The banking details will be sent to the Guests after their booking is made.

5. Covid-19 Cancel Conditions

For the 2024 season, Sherpas Ride offers free cancellation and full refund of all deposits and payments for all Trips should there be COVID-19 related travel ban in force, which stops outbound travel from your home country or inbound travel to a trip destination or if a mandatory quarantine on arrival into a Trip’s destination is in place.

Sherpas Ride reserves the right to cancel the Trip (upon assessing the COVID-19 situation and related travel restrictions developments) and refund all deposits and payments to all Guests booked to mentioned Trip.

Requirement for proof of Negative Covid-19 test and/or vaccination upon entry to Trip’s destination is not considered a “travel ban”.

We will be in close touch with all booked Guests and inform you about the current status of your trip. On some of our Trips more detailed cancel conditions will be explained on your travel invoice (and discussed prior to the booking).

Since a flight ticket is not part of the package, we strongly recommend buying only 100% refundable flight tickets (even for cancellation for no reason) or waiting with ticket purchase until we instruct you to do so. We won’t be able to refund flight tickets if we are forced to cancel a Trip due to the above-mentioned reasons.

6. Covid-19 Requirements on guests

Depending on the severity of the covid situation at the moment of starting the Trip, Guests can be obliged to present proof of the Negative Covid-19 test upon starting a Trip (such requirement will be discussed prior to the trip).

We recommend Guests get vaccinated against Covid-19. If Guests are not able to enter the Trip’s destination due to a travel ban on non-vaccinated travelers, we won’t refund your deposits due to such reasons. 

7. Cancellation by Guests

Sherpas Ride strongly advises the Guests to arrange individual cancellation insurance. 

In case Guests want to cancel their participation in any Trip, such information must be sent to Sherpas Ride via email. After a cancellation email is received, Sherpas Ride will charge the respective Guest with cancellation fees according to the date when the cancellation was made.

The Cancellation Fees:

if the cancellation is made:

More than 10 weeks before the Trip starts – the deposit is forfeited

31 days – 10 weeks – 75% of the total cost

0-30 days – 100% of the total cost

*that said, Sherpas Ride always tries to find a replacement for the Guest to be able to refund in full

8. Cancellation by Sherpas Ride

Sherpas Ride reserves the right to cancel any Trip before it is confirmed to run. A Trip is confirmed to run once it has reached the minimum number of participants required as defined by Sherpas Ride. Sherpas Ride permits and inform its Guests to buy any travel tickets or accommodation (in case of a Trip where no accommodation is provided by Sherpas Ride) connected to the Trip only when the minimum participation is reached.

Sherpas Ride reserves the right to cancel any Trip prior to departure, including a confirmed Trip, due to circumstances beyond our control.

If this occurs, Sherpas Ride will refund the whole payment to those Guests whose Trip was canceled.

In case of Trip cancellation or cancellation of part of the Trip’s program (e.g. Guide’s injury),  Sherpas Ride is obliged to deliver agreed features via third-party providers. If not possible, Sherpas Ride has to refund the features of the program that it was not able to deliver.

9. Cancellation by Force Majeure

Sherpas Ride nor Guest(s) will be liable for any failure in fulfilling an obligation under thee Terms and Conditions that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, war, riots, terrorist act, epidemic, pandemic, quarantine, outbreaks of infectious disease or any other public health crisis, civil commotion, breakdown of communication facilities, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy.

For the avoidance of doubt, Force Majeure shall not include (a) financial distress nor the inability of either party to make a profit or avoid a financial loss, (b) changes in market prices or conditions, or (c) a party’s financial inability to perform its obligations hereunder.

In case a trip is canceled or terminated by Force Majeure, Sherpas Ride will refund the Guests with the cost of the Trip reduced by the expenditures Sherpas Ride already made prior to the cancellation/termination.

10. Trip Program/Schedule Changes

Flexibility is key in all our Trips and enables us to deliver what you expect from us. Sherpas Ride reserves the right to make changes to the program or schedule of any Trip based on current meteorological conditions, avalanche risk level, and/or any other objective dangers and circumstances and/or the current physical shape and performance of a group of Guests. By agreeing to these Terms & Conditions, Guests confirm they understand and accept such changes even if those changes are not invoked or caused by the respective Guest. Guests also agree they accept the risk of changes based on the group nature of any Trip and that they waive any compensations or discounts.

Sherpas Ride reserves the right to change an itinerary after departure due to local circumstances, such as snow and weather conditions, or a Force Majeure Event. In such emergency circumstances, the additional cost of any necessary itinerary alterations will be covered by the Guests. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itineraries including but not limited to visa or non-refundable flights.

11. Behaviour of Guests

Sherpas Ride reserves the right to terminate without notice and liability the arrangements of any Guest whose participation is inappropriate or dangerous for namely but not limited to: health reasons, lack of experience or skills, or inappropriate equipment regardless of the cause of such fault and/or whose behavior is such that it is likely, in Sherpas Rides reasonable opinion, to cause distress, danger, damage, or annoyance to other Guests, employees, property or to any third party. In the rare occasion that Guests’ skills and/or their fitness does not meet the recommended requirements needed to participate in the Trip, Sherpas Ride reserves the right to respectfully assign the Guest to a private instructor at an additional cost.  In all cases described above, full cancellation charges apply and Sherpas Ride will be under no obligation whatsoever for any cost incurred. Every Guest is obliged and agrees to respect all instructions of the Guide during the Trip preparation and throughout the course of the Trip.

12. Sherpas Ride’s Liabilities

Sherpas Ride undertakes to organize every Trip in favor of its Guests so the objective risks connected to participating in the Trip are minimized. Sherpas Ride is not liable for any damages it has not caused. In case of Sherpas Ride finds out a Trip does not have the agreed features, which were supposed to be an integral part of the respective Trip and the Guests could expect those features to be rendered by Sherpas Ride based on the Trip description or common knowledge, Sherpas Ride will, shall it does not impose inappropriate costs, take respective remedial action. Guests must inform Sherpas Ride about any imperfections identified throughout the course of any Trip. In case it is not possible to continue the Trip in any other way than through a lower-quality program, compared to the Trip description, Sherpas Ride will reimburse the affected Guests with the cost difference.

13. Age & Health

The minimum Age for Sherpas Ride Trips is 18 at the time of travel. All Guests under the age of 18 must be accompanied by a legal guardian. There is no upper age limit on our trips, however, please bear in mind that can be physically demanding and Guests bear responsibility for their own sport and health shape and preparation for a concrete Trip. Sherpas Ride can provide more details about the fitness requirements of each Trip. If you are unsure whether you can participate, we recommend consulting a medical expert.

14. Participation at Guests Own Risk

Our Guests acknowledge that the nature of the trip may be adventurous and participation involves a degree of personal risk. Skiing, snowboarding, mountain biking, or any adventure activity can involve certain hazards, including sudden weather changes and avalanches. Our Guests acknowledge there is no absolute guarantee of safety. 

Every Guest participates at any Trip or its sports program at his/her own risk and responsibility and understands the activities facilitated by Sherpas Ride might be dangerous regardless of applying all efforts and appropriate care to minimize those risks. The instructors, guides, and coaches that facilitate each Trip act as organizational/operational bodies only. Sherpas Ride and its contractors accept no liability for death, injuries, or illness incurred during your trip. Nor do we accept responsibility for any service provided by any other tour operators.

Any Guest has the right to diverge from the course of any Trip as scheduled by Sherpas Ride and/or specified by the Guide only after such divergence is agreed by the Guide. In case any Guest diverges from the Trip’s program or schedule he/she agrees he/she acts at his/her own risk and neither Sherpas Ride nor the Guide is responsible for the safety of the respective Guest. The Guests agree to adhere to the safety/security instructions of Sherpas Ride even in case they diverge from the Trip’s program or schedule.

15. Photos and videos

All guests agree to the use of photos and videos taken during the Sherpas ride for future promotional purposes, thereby granting Sherpas Ride a non-exclusive, royalty-free, perpetual license to use such photos and videos. If you do not wish your photos to be used, we require confirmation by email

Photographs or videos appearing on the website should be used solely as an indication of facilities and attractions. Actual facilities and attractions may vary according to the itinerary.

16. Equipment

Should a Guest decide to use any equipment provided by Sherpas Ride, namely but not limited to skis, snowboards, snowshoes, poles, backpacks, avalanche kits, etc., such Guest is responsible for the equipment and its loss or damage. The Guests are fully liable for the necessary repairs or replacements of equipment Sherpas Ride provides them with.

17. Insurance

Throughout the course of the whole Trip, all participating Guests are obliged to have valid medical expenses insurance with insurance indemnity limits appropriate to the risks of accidents or circumstances that can be duly expected concerning participation at a respective Trip. Sherpas Ride will suggest and offer the facilitation of appropriate insurance. In case any Guest decides to make other insurance than the one suggested by Sherpas Ride, the Guest has to inform Sherpas Ride about it within 10 days prior to the start date of the respective Trip. In case any accident or other circumstances occur, the Trip Head will not take account of whether or not the Guest’s insurance has sufficient indemnity limits. Guests’ insurance has to particularly cover activities such as skiing off-piste and out of the marked trail, ski-touring or split-boarding, and in case of Ski and Sail trip, ski touring beyond polar circle (70° North). Guests are strongly recommended to arrange Cancel Insurance in case of Guest’s illness, injury, Covid, or other unexpected events.

18. Assistance

In case a Guest suffers from an accident, illness, or injury connected to the activities facilitated by Sherpas Ride, Sherpas Ride will offer an appropriate level of help and support while claiming damage indemnification from third parties.

19. Protections and personal data

Guests understand that Sherpas Ride is authorized to process their personal data for the purpose of fulfilling obligations and for the purpose of fulfilling legal obligations, in particular: name, surname, date of birth, necessary passport details, bank details, place of residence, or other contact address, e-mail address, telephone connection, data on health status – especially allergies, medications used and other health problems. All personal data will only be stored for the period specified by law, or for the period absolutely necessary.

20. Final Provisions

Should any part of these Terms & Conditions be invalid for any reason, the rest of the agreement shall remain unaffected and valid.

All contractual and non-contractual obligations or possible future disputes arising from these obligations, to which these Terms and Conditions apply, are governed by Czech law.

A customer who has purchased goods or services online as a consumer may use the online dispute resolution platform to resolve the dispute. More detailed information on the terms of dispute resolution online is available at http://ec.europa.eu/odr.

All possible future disputes arising from obligations to which these Terms and Conditions apply are subject to the jurisdiction of the District Court for Prague 7″

These General Terms and Conditions are effective from 14 December 2023.
